NO. 10-16696 UNITED STATES COURT OF APPEALS FOR THE NINTH CIRCUIT KRISTIN PERRY, et al., Plaintiffs-Appellees, v. ARNOLD SCHWARZENEGGER, et al. Defendants. Appeal from United States District Court for the Northern District of California Civil Case No. 09-CV-2292 VRW (Honorable Vaughn R. Walker) DEFENDANT-INTERVENORS-APPELLANTS DENNIS HOLLINGWORTH, GAIL J. KNIGHT, MARTIN F. GUTIERREZ, MARK A. JANSSON, AND PROTECTMARRIAGE.COM'S MOTION TO EXCEED PAGE LIMITATIONS Andrew P. Washington, D.C. 20036 (202) 220-9600; (202) 220-9601 Fax Attorneys for Defendant-Intervenors-Appellants Pursuant to Ninth Circuit Rule 32-2, Appellants respectfully seek the Court's leave to file an Emergency Motion for Stay Pending Appeal in excess of the twenty pages allotted by rule for motions. See Fed. R. App. P. 27(d)(2). Specifically, Appellants respectfully request the Court's leave to file a motion of no more than 75 pages in length. This request is amply justified by the district court's 136-page ruling supporting the judgment Appellants seek to stay. See Doc. No. 708. That judgment enjoins enforcement of Proposition 8, a voter-initiated amendment to the California Constitution providing that "[o]nly marriage between a man and a woman is valid or recognized in California." Appellants submit that this case raises numerous momentous issues, both legal and factual, of overriding importance not only to the parties, but to the People of California and to the Nation at large. Appellants respectfully submit that a 75-page motion is warranted to address these matters fairly and efficiently. We therefore request leave to file a motion of no more than 75 pages in length.
