R. 27.0(d) Appeal Nos. 10-1883 and 10-2052 are consolidated for purposes of briefing and oral argument. See Fed. R. App. P. 3(b)(2). Appeal No. 10-1947 is a cross-appeal to the consolidated cases. Pursuant to Fed. R. App. P. 28.1, it is hereby ordered that the above-named plaintiffs be deemed the appellants/cross-appellees ("appellants") and that defendant Joel Tenenbaum be deemed the appellee/cross-appellant ("appellee"). The parties are directed to use the above caption on all future filings related to these cases. The briefing schedule previously set in Appeal Nos. 10-1883 and 10-1947 on August 31, 2010 is hereby vacated. The following is the new briefing schedule for these appeals: First Brief: Appellants' principal brief and appendix are due on or before October 27, 2010.
Second Brief: Appellee's principal/response brief must be filed within 30 days of service of the first brief; Third Brief: Appellants' response/reply must be filed within 30 days of service of the second brief; and
