On Appeal From the United States District Court For the District of Massachusetts MOTION TO AMEND THE CAPTION Plaintiffs-Appellants/Cross-Appellees Sony BMG Music Entertainment, Sony BMG Music Entertainment, Warner Bros. Records Inc., Arista Records LLC, and UMG Recordings, Inc., respectfully move this Court to amend the caption in these consolidated appeals to remove "Atlantic Recording Corporation" as a Plaintiff-Appellant/Cross-Appellee. Although Atlantic Recording Corporation was initially a Plaintiff in the proceeding below, the district court dismissed it from the case on July 20, 2009. See Ex. A, July 20, 2009 Electronic Clerk's Notes, 1:03-cv11661; Ex. B, Notice of Dismissal of Pl. Atlantic Recording Corporation, 1:03-cv- Dockets.Justia.com 11661, Consol. Doc. No. 891. As a result, although the district court continued to list Atlantic Recording Corporation in the case caption, Atlantic Recording Corporation was not a party to the court's July 9, 2010 final judgment and is not a party to any of the instant appeals. See Ex. C, Amended Judgment, 1:07-cv-11446, Doc. No. 48.
