UNOPPOSED MOTION TO EXPEDITE APPEAL
The federal defendants-appellants, with the consent of
plaintiff-appellee, respectfully request that the Court expedite
this appeal.

This is a Freedom of Information Act suit in which

the district court has ordered the depositions of two federal
inmates, one of whom has been sentenced to death.

To avoid

burdening the Court at this time with a motion for a stay pending
appeal, the parties have agreed to delay holding the depositions
and to request expedition from this Court.
To aid in the expeditious consideration of this appeal, the
federal defendants, again with the consent of plaintiff, ask that
the Court enter a briefing schedule under which appellants’
opening brief will be due December 15, appellee’s response brief
on January 14, and appellants’ reply brief on January 29.
