On January 21, 2009, after Plaintiff/Appellee had filed his Brief in this appeal,
President Barack Obama issued a Memorandum to all federal agencies directing that
henceforth a “presumption of disclosure should be applied to all decisions involving
FOIA.” That Memorandum was published in the Federal Register on January 26, 2009.
See 74 FR 4683. A copy of that Memorandum is also attached as Exhibit A. FBI
Defendants/Appellants, however, did not discuss that directive in their Reply
Memorandum. Plaintiff/Appellee, therefore, hereby requests that it be included as part
of the record on this appeal.
