Even so, a potential timing issue existed if the United States were permitted to file an amicus brief in support of the appellants on the proposed extension date of February 25 and the appellees were to file their brief, as then scheduled, on February 27. In view of that potential timing issue, the appellees were unable to consent to the United States’ motion and were undecided on whether they would file a written opposition. On Friday, February 1, 2013, the Court granted the parties’ joint motion for an extension of the appellees’ briefing period, thereby resolving the potential timing issue. Accordingly, the appellees hereby consent to the United States’ motion for a twenty-one (21) day extension of time in which to file an amicus brief. 1 The United States does not require any extension of time if it determines to file an amicus brief in support of the appellees. 6 RESPECTFULLY SUBMITTED this 4th day of February 2013.
