Dear Mr. Ley:
The Court has before it a pending motion by the United States for an
extension of time to file an amicus brief in this case. The motion was filed in order
to afford sufficient time for the Solicitor General to determine whether the
government’s participation as an amicus curiae in this appeal was warranted. We
are now writing to inform the Court that the United States will not be filing an
amicus brief in this case. The pending motion is therefore moot and may be
dispensed with accordingly.
