UNITED STATES COURT OF APPEALS FOR THE SECOND CIRCUIT THE FOOOTBALL ASSOCIATION PREMIER LEAGUE LIMITED, et al v. YOUTUBE INC, et al. Case No. 10-3342 PLAINTIFFS-APPELLANTS’ RESPONSE TO MOTION FOR LEAVE TO FILE BRIEF AS AMICUS CURIAE Plaintiffs-Appellants The Football Association Premier League Ltd. et al. submit this response to the motion of Public Knowledge for leave to file a brief as amicus curiae. On December 10, 2010, Audible Magic Corp. sought leave to file an amicus curiae brief in support of neither party for the purpose of explaining the functions and reliability of its filtering technology. This Court has not yet acted on Audible Magic’s motion.1 The proposed brief by Public Knowledge is largely devoted to responding to Audible Magic’s proposed brief and to discussing Audible Magic’s filtering technology. See, e.g., Public Knowledge Br. at 3-5, 9, 19. For this reason, Plaintiffs-Appellants believe that Public Knowledge should only be permitted to file its brief if Audible Magic is granted similar permission. DATED: April 18, 2011 Respectfully submitted, _________/s_____________________ John C. Browne BERNSTEIN LITOWITZ BERGER & GROSSMANN LLP 1285 Avenue of the Americas New York, NY 10019 (212) 554-1400 johnb@blbglaw.com Charles S. Sims William M. Hart  Noah Siskind Gitterman Elizabeth A. Figueira PROSKAUER ROSE LLP Eleven Times Square New York, New York 10036 (212) 969-3000 1 Defendants-Appellees neither consented to, nor objected to, the filing of Audible Magic’s brief. See Appellees’ Response to Motions for Leave to File Briefs as Amici Curiae, Nos. 10-3270 & 10-3342 (filed Dec. 16, 2010).
