The brief makes reference, in three sentences, to information that is subject to the Second Amended Stipulated Pre-Trial Protective Order, entered on May 15, 2008, in the district court (the "Protective Order"). In particular, in three sentences, the brief references material that has been designated Confidential or Highly Confidential by defendants-appellees (although plaintiffs do not perceive any good reason for that designation). In addition to the Protective Order, on request of the defendants, the district court separately ordered that this protected information be redacted from filings in the district court. The Protective Order and separate sealing order are attached hereto as exhibits A and B, respectively. 2 4. Plaintiffs have asked the defendants to de-designate those three sentences, but defendants have not agreed to do so. Accordingly, we are constrained to request permission to file a copy of our appellants' brief under seal on December 3, 2010, and to thereafter file a copy of our brief on the public docket with the protected sentences redacted from the public version. In the case o f a deposition: a. Deposition transcripts shall be deemed temporarily designated as HIGHLY CONFIDENTIAL, provided that within thirty (30) days aftcr receipt o f t h c transcript, counscl shall review the transcript and dcsignate only those pages o f the transcript that the designating party believes constitutc, rcflect, or disclose HIGHLY CONFIDENTIAL information. I f n o specific designation is made, the entire transcript will be deemed CONFIDENTIAL. Notwithstanding any automatic or specific designations under this paragraph, the other parties may object to HIGHLY CONFIDENTIAL or CONFIDENTIAL designations pursuant to paragraph I I. b. The non-party shall h a v e the s a m e right as a party to object to the expert, as related to disclosure o f the n o n - p a r t y ' s H i g h l y Confidential 12 ----------- infonnation, pursuant to the procedures in this paragraph except that a n o n - p a r t y ' s time to object as provided in ~ 7(a) shall be 10 days from receipt o f the disclosure. 8. Notwithstanding anything herein to the contrary, (a) the filing o f any infonnation designated CONFIDENTIAL o r HIGHLY CONFIDENTIAL under seal shall be governed by the applicable Rules o f the United States District Court for the Southern District o f New York; (b) the party who designated the document, interrogatory answer, rcsponse to request for admission, or transcript as CONFIDENTIAL or HIGHLY CONFIDENTIAL shall be deemed to be the party requesting the record be filed under seal; and (c) the other parties shall have no obligation hereunder with respcct to the requirements o f any applicable rulc other than to cooperate in the requcst. Any infonnation designatcd as CONFIDENTiAL or HIGHLY CONFIDENTIAL may b e introduced in any pretrial court procceding in this case in opcn court unless the producing party obtains an appropriate protective order from the Court, and provided thc party seeking to introducc thc matcrial has provided sufficient notice to the producing party o f the intent to introducc or file the confidcntial matcrial in open court to enable the producing party to obtain such an order. I t shall be the duty o f the parties to ensure that all documents produced to them by non-parties and marked CONFIDENTIAL o r HIGHLY CONFIDENTIAL are filed under seal pursuant to the applicable Rule o f the Unitcd States District Court for the Southern District o f New York. In addition, any infonnation designated as CONFIDENTIAL or HIGHLY CONFIDENTIAL by a non-party may be introduced in a pretrial court proceeding in this casc in open court only i f the party seeking to introduce the material first seeks the advance written pennission o f the producing non-party. I f the producing non-party dcclines to grant such pennission or fails to respond within 5 calendar days, the party seeking to introducc the material may seek an order from the Court permitting the introduction o f such infonnation.
