Google Inc., 12-2402 Dear Ms. Wolfe: This firm represents the plaintiffs in McGraw Hill v. Google, 05-cv-8881, pending in the U.S. District Court for the Southern District of New York. That case is consolidated with The Authors' Guild v. Google, 05-cv-8136. A petition recently was filed in The Author's Guild case, seeking review in this Court of a class certification decision. That has been assigned Second Circuit index number 12-2402. The Court's docket for this petition lists the plaintiffs in the 05-cv-8881 action as involved in the petition now before this Court, but they are not. The petition relates solely to 05-cv-8136. I ask that the Court amend its docket accordingly. If you would like additional information, please do not hesitate to let me know. Thank you for the Court's attention to this matter. Respectfully, /s/ Bruce P. Keller 23688281v1 New York • Washington, D.C. • London • Paris • Frankfurt • Moscow • Hong Kong • Shanghai
