RE: Mark Hagans v. Commissioner Social Security
Case Number: 11-2526
District Case Number: 2-10-cv-01951
Dear Counsel:
At the direction of the Court, Counsel for the parties are directed to submit letter briefs of
no longer than five pages by January 13, 2012 addressing what level of deference, if any, the
Court should give to Acquiescence Ruling 92-2(6) (the "AR"). In addition, the parties are
directed to address whether the policy described in the AR was in existence in some form prior
to the issuance of the AR. The parties may move the Court for leave to supplement the record
with any documents relating to this policy, including written documentation or affidavits
concerning the formulation of the policy and any documents which set forth this policy,
regardless of whether they were produced before or after the AR.
Please file the responses to the Court's letter using the "response event" under the argument
notices and acknowledgment category in CM/ECF.
Very truly yours,
Marcia M. Waldron, Clerk
