Francis Akinro v. Towson Library Doc. 6 Case 1:10-cv-01458-BEL Document 9 Filed 06/21/10 Page 1 of 2 IN THE UNITED STATES DISTRICT COURT FOR THE DISTRICT OF MARYLAND FRANCIS AKINRO Plaintiff v. AVIS CAR RENTAL, et al. Defendants * * * * * *** ORDER These cases were summarily dismissed pursuant to 28 U.S.C. § 1915(e). Plaintiff filed a Notice of Appeal in each case, both of which have been processed and transmitted to the United States Court of Appeals for the Fourth Circuit. The Court has now received Plaintiff's Motion and Affidavit for leave to appeal In Forma Pauperis. Paper No. 6. Plaintiff, who was permitted to proceed in forma pauperis in the district court action, shall be denied leave to proceed in forma pauperis on appeal in both cases. The original Complaints plainly contained fanciful and frivolous claims and the Court finds that there is no arguable basis from which an appeal may lie. Plaintiff, who has filed approximately 25 cases in this Court over the past month, all of which were dismissed sua sponte, now seeks to impose his vexatious behavior on the appellate court. The Court certifies that the appeals are not taken in good faith. See Fed. R. App. P. 24(a)(3)(A). Accordingly, it is this 18th day of June 2010, by the United States District Court for the District of Maryland, hereby ORDERED that: 1. Plaintiff's Motions for Leave to Appeal In Forma Pauperis in the above-captioned cases (Paper No. 6) ARE DENIED; and CIVIL ACTION NOS. L-10-1300 L-10-1458 USCA CASE NOS. 10-1631 & 10-1666 Dockets.Justia.com Case 1:10-cv-01458-BEL Document 9 Filed 06/21/10 Page 2 of 2 2. The Clerk SHALL SEND a copy of this Order to Petitioner and SHALL TRANSMIT a copy of the Order to the Clerk for the United States Court of Appeals for the Fourth Circuit pursuant to Fed. R. App. P. 24. /s/ ______________________ Benson Everett Legg United States District Judge 2
