OPINION filed : AFFIRM the denial of relief on Pillette s Fifth Amendment Miranda claim and Sixth Amendment Confrontation Clause claim, and REVERSE the grant of relief on Pillette s ineffective assistance claim. And because the district court erred in granting the writ, we also REVERSE its order barring re-prosecution; pursuant to rule 34(j)(2)(c), decision not for publication pursuant to local rule 28(g).
