OPINION and JUDGMENT filed : The denial of class certification and the grant of summary judgment on Davis's disparate-impact claims and her 2004 disparate-treatment claim are AFFIRMED. The grant of summary judgment on Davis's 2003 disparate-treatment claim is REVERSED, and the case is REMANDED to the district court for further proceedings. Decision for publication. Danny J.
