OPINION filed : We AFFIRM the district court's grant of summary judgment to TANK on the basis that BBC lacked standing. As to Defendant City of Covington, we AFFIRM the district court's dismissal of BBC's First Amendment and Equal Protection claims against Covington and the court's declaration that O-2-09 is constitutional, in that it does not, as applied to BBC, violate either the First or Fourteenth Amendments. Decision not for publication pursuant to local rule 206. Helene N.
