OPINION filed : The district court properly dismissed the 1981 and 1983 claims against the City of Warrensville Heights and the City of Cleveland. The district court also properly dismissed Plaintiff's state-law claims with prejudice, with the exception of the state law claims against ODRC. Because the district court lacked subject-matter jurisdiction, dismissal should have been without prejudice. Therefore, we AFFIRM the district court's judgment except to the extent that the dismissal of the claims against ODRC was with prejudice, with prejudice, which is VACATED, decision not for publication.
