IN CONSIDERATION WHEREOF, it is ORDERED that the convictions and sentences
of Kilpatrick and Ferguson are AFFIRMED. However, the district court’s restitution award
against Kilpatrick to the Detroit Water & Sewerage Department is VACATED and
REMANDED for proper calculation of the award.
