OPINION filed : the judgment of the district court is REVERSED and REMANDED, with instructions to enter a conditional writ of habeas corpus giving the State of Ohio six months to retry or dismiss the involuntary-manslaughter charge, and further providing that if the state chooses to dismiss the charge, it shall resentence Smith on the remaining felonius-assault conviction.
