ORAL ORDER from the bench requesting the parties brief the question whether the district court had subject matter jurisdiction of this case. In so doing, please address the applicability, if at all, of Louisville & Nashville Railroad v. Mottley, 211 U.S. 149 (1908), T.B. Harms. Co. v. Eliscu, 339 F.2d 823 (2d Cir. 1964), and the Declaratory Judgment Act, 28 U.S.C. ยงยง 2201-02. Briefs must be filed within 14 days of oral argument. See Fed. R. App. P. 26.
