In so doing, please address the applicability, if at all, of Louisville & Nashville Railroad v. Mottley, 211 U.S. 149 (1908), T.B. Harms. Co. v. Eliscu, 339 F.2d 823 (2d Cir. 1964), and the Declaratory Judgment Act, 28 U.S.C. ยงยง 2201-02. Briefs must be filed within 14 days of oral argument. See Fed. R. App. P. 26.
