District Court Jurisdiction:
The Court has jurisdiction of this action under 42 U.S.C. § 1983 to redress deprivations of
constitutional rights under color of state law and 28 U.S.C. § 1331, 1343, 1361 and the Fifth
and Fourteenth Amendments to the United States Constitution. Jurisdiction is also conferred
upon this Court for the entry of declaratory relief under 28 U.S.C. 2202 and 2210.
Court of Appeals Jurisdiction:
The Court of Appeals has jurisdiction under 28 U.S.C. §1291. On April 26, 2011, the
District Court granted Defendant’s Motion to Dismiss on Plaintiff’s Section 1983. The Notice
of Appeal was filed on May 19, 2011.

No pending motions are currently in the District Court.
