MDY Industries, LLC v. Blizzard Entertainment, Inc., et al Doc. 55 No. 09-15932 In the UNITED STATES COURT OF APPEALS FOR THE NINTH CIRCUIT MDY INDUSTRIES LLC AND MICHAEL DONNELLY, Plaintiffs-Appellants, v. BLIZZARD ENTERTAINMENT, INC. AND VIVENDI GAMES, INC., Defendants-Appellees. APPEAL FROM THE UNITED STATES DISTRICT COURT, DISTRICT OF ARIZONA CASE NO. 06 CIV. 2555 JUDGE DAVID G. CAMPBELL Joint Motion for Extension of Time to File Petitions for Panel Rehearing Lance C. Venable Joseph R. Meaney Venable, Campillo, Logan & Meaney, P.C. 1938 East Osborn Rd. Phoenix, Arizona 85016 (602) 631-9100 Attorneys for Plaintiff-Appellant Dockets.Justia.com The parties jointly request that the Court grant a 30-day extension of the time within which they can file their respective petitions for panel rehearing from the current due date of December 28, 2010 to Friday, January 27, 2011. Good cause supports this motion. The lead counsel for both parties have unchangeable vacation plans for the upcoming holidays whereby they will not return to their respective offices until January 10, 2011. The parties have diligently discussed the matter together. Because of the difficult and complex nature of this case, the parties' counsel will require sufficient time to brief the requests to the Court. A 30-day extension would give the parties adequate time to prepare their respective petitions after returning from vacation without the need to request additional time. Therefore, the parties respectfully ask the Court to grant the requested 30-day extension of time. /s/Lance C. Venable Lance C. Venable Venable, Campillo, Logan & Meaney, P.C. 1938 East Osborn Rd.
