Larson, Appeal No. 11-56034 Dear Marc: In light of Dan’s back-to-back federal trials this month, we will be filing a motion on Friday with the Court of Appeals asking for a final, brief, roughly two-week extension of the due date for our Principal and Response Brief in the Siegel appeal—from March 6, 2012, to March 23, 2012. Dan just completed a three-week trial in front of Judge Matz on February 10, 2012, and began a second trial yesterday in front of Judge Guilford in Orange County that is expected to end in early March. He has a third federal trial set to commence in New York on March 26, in front of Judge Scheindlin. Given Dan’s schedule, and that Ms. Larson had 209 days from the date her notice of appeal was filed to the date her Principal Brief was filed, we hope that Ms. Larson will not object to our motion. If approved, we would have 92 days to file our brief. Please let us know by 2pm PST this Friday, February 17, whether Ms. Larson will oppose our request. We will file our motion that afternoon.
