Dear Ms. Dwyer,
On Tuesday, February 7, 2017, the parties presented oral argument to the Court. During the
argument, Judge Friedland asked the States whether they would be presenting additional
evidence in the district court and the nature of that evidence. I am writing to inform the Court
that the States will be filing at least 15 additional declarations in the district court today,
regarding harm to the States. Two of these, concerning concrete harm to Washington’s
universities, have already been filed. They are at Docket No. 66, Declaration of R. Branon,
University of Washington, Continuum College and Docket No. 67, Third Declaration of A.
Chaudhry, Washington State University.
