ORDER that: 1. The plaintiff's objection 15 to the Recommendation of the Magistrate Judge filed on August 16, 2013 are overruled; 2. The Recommendation of the Magistrate Judge 14 entered on August 15, 2013 is adopted; 3. That the motion to dismiss 7 filed by the Defendant, Winn Dixie, is GRANTED in part as to Jeter's Title VII claims. 4. That the motion to dismiss 7 is DENIED in part as to Jeter's claims for discrimination and retaliation under the ADA. 5.
