JUDGMENT, in accordance with the memorandum opinion entered this date, it is the ORDER, JUDGMENT, and DECREE of court as follows: (1) plf's objections are overruled; (2) the 35 and 44 Report and Recommendation of the Magistrate Judge are adopted; (3) defs Dale County, Alabama, Wally Olson, and Ron Nelson's 12 and 13 Motions to Dismiss are granted; (4) def Dale County, Alabama is dismissed with prejudice, defendants Olson and Nelson are dismissed without prejudice, and al l three are terminated as parties; further ORDERING that costs are taxed against the plf, for which execution may issue; directing the clerk to enter this document on the civil docket as a final judgment pursuant to rule 58 FRCP; this case is not closed.
