JUDGMENT, in accordance with the memorandum opinion entered this date, it is the ORDER, JUDGMENT, and DECREE of court as follows: (1) plf's objections are overruled; (2) the 35 and 44 Report and Recommendation of the Magistrate Judge are adopted; (3) defs Dale County, Alabama, Wally Olson, and Ron Nelson's 12 and 13 Motions to Dismiss are granted; (4) def Dale County, Alabama is dismissed with prejudice, defendants Olson and Nelson are dismissed without prejudice, and al l three are terminated as parties; further ORDERING that costs are taxed against the plf, for which execution may issue; directing the clerk to enter this document on the civil docket as a final judgment pursuant to rule 58 FRCP; this case is not closed. (3) Defendants Dale County, Alabama, Wally Olson, and Ron Nelson's motions to dismiss (Doc. Nos. 12 & 13) are granted (4) Defendant with prejudice, dismissed Dale County, defendants without Alabama Olson prejudice, and and all is dismissed Nelson are three are terminated as parties. It is further ORDERED that costs are taxed against plaintiff, for which execution may issue. The clerk of the court is DIRECTED to enter this document on the civil pursuant to Rule 58 of docket the as a Federal final Rules Procedure. This case is not closed.
