J&J Sports invokes the court's jurisdiction pursuant to 28 U.S.C. § 1331. On October 10, 2008, this court issued an order requiring that J & J Sports show cause as to why this case should not be dismissed for want of prosecution because the defendants had not been served. filed no response to the show-cause order. J & J Sports This case is therefore due to be dismiss without prejudice for want of prosecution. An appropriate judgment will be entered. DONE, this the 30th day of October, 2008. /s/ Myron H.
