MEMORANDUM OPINION AND ORDER: The 48 Motion for Summary Judgment is GRANTED in part and DENIED in part as further set out in the order. The court declines to exercise supplemental jurisdiction over the state law claim in Count Ten of the Amended Co mplaint, pursuant to 28 U.S.C. § 1367 (c) (1), (2), and Count Ten is DISMISSED without prejudice.
