of the file in this case and upon consideration of the Recommendation of the Magistrate

ORDERED and ADJUDGED that the Recommendation of the Magistrate Judge
be and is hereby ADOPTED as follows:

The defendant’s motion for summary judgment be GRANTED;

(2)

Judgment be GRANTED in favor of the defendants;

(3)

This case be DISMISSED with prejudice;

(4).
