MEMORANDUM OPINION AND ORDER; that Defendant's Motion to Dismiss Collective Action 6 is GRANTED. The individual claims brought by Plaintiff remain, but the FLSA collective action allegations are DISMISSED without prejudice. Plaintiff is GRANT ED leave to and including January 25, 2011, to file a motion to amend the complaint, consistent with the directives herein.
