MEMORANDUM OPINION AND ORDER that plaintiff's 10 motion to remand and the parties' 26 joint motion to allow remand are GRANTED and that this case is REMANDED to the Circuit Court of Barbour County, Alabama; that oral argument presently set for January 25, 2011, is CANCELED; that the clerk is DIRECTED to take the action necessary to accomplish the remand of this case to the Circuit Court of Barbour County.
