On August 17, 2012, the Magistrate Judge filed a Recommendation (Doc. # 21)
to which Plaintiff objected (Doc. # 22). Based upon an independent and de novo
review of those portions of the Recommendation to which objection is made, see 28
U.S.C. § 636(b), it is the ORDER, JUDGMENT and DECREE of the court that:

Plaintiff’s Objection is OVERRULED;
2.
The Recommendation of the Magistrate Judge is ADOPTED as the
opinion of this court; and
3.
The decision of the Commissioner is AFFIRMED.
