1. The petitioner's Objection to the Magistrate Judge Recommendation (Doc. #58)
filed on May 27, 2014 is overruled;
2. The Recommendation of the United States Magistrate Judge (Doc. #55) entered
on April 23, 2014 is adopted;
3. The petition for writ of habeas corpus filed by Nicholas Wells on February 15,
2012 is DENIED as it was not filed within the one-year period of limitation mandated by 28
U.S.C. § 2244(d)(1).
4. This case is DISMISSED with prejudice.
