ORDER directing that, after an independent review of the file, it is the ORDER, JUDGMENT and DECREE of the court that: (1) The petitioner's 17 objection to the Recommendation of the Magistrate Judge filed on October 4, 2012 is overruled; (2) T he 16 Recommendation of the Magistrate Judge filed on October 1, 2012 is adopted; and (3) The 28 U.S.C. § 2241 petition for habeas corpus relief filed by Manuel is DISMISSED without prejudice to afford Manuel an opportunity to exhaust all available state court remedies.
