Accordingly, it is ORDERED that the

Recommendation of the Magistrate Judge is ADOPTED, that Plaintiff’s motion for
preliminary injunction (Doc. # 31) is DENIED, and that this case is referred back
to the Magistrate Judge for additional proceedings.
