ORDER
On June 26, 2014, the Magistrate Judge filed a Recommendation in this
case, (Doc. # 35), to which Plaintiff has filed timely Objections, (Doc. # 41). The
court has conducted an independent and de novo review of those portions of the
Recommendation to which objection is made. See 28 U.S.C. § 636(b)(1).
Upon consideration of the Recommendation and the Objections, it is
ORDERED that the Recommendation is ADOPTED, the Objections are
OVERRULED, Defendants’ motion to dismiss (Doc. # 17) is GRANTED, and this
case is DISMISSED without prejudice for lack of subject-matter jurisdiction.
