ORDER: Upon consideration of the parties 34 Joint Stipulation of Dismissal, which comports with FRCP Rule 41(a)(1)(A)(ii), this action has been dismissed with prejudice by operation of Rule 41, on the terms agreed to and set out by the parties. Accordingly, Defendants 17 Motion for Summary Judgment and Plaintiffs 35 Motion to Dismiss are DENIED as moot. The Clerk of the Court is DIRECTED to close this case. agreed to and set out by the parties. Accordingly, Defendants’ Motion for Summary
Judgment (Doc. # 17) and Plaintiff’s Motion to Dismiss (Doc. # 35) are DENIED as
moot.
The Clerk of the Court is DIRECTED to close this case.
