OPINION
Plaintiff filed this lawsuit asserting a claim of
malicious

prosecution,

indictment,

and

stemming

eventual

acquittal

arrest,

conspiracy to commit bank and wire fraud and aggravated
identity theft.

This lawsuit is now before the court

on the recommendation of the United States Magistrate
