O P I N I O N and ORDER T h is litigation is now before the court on the recommendation of the United States M a g is tra te Judge entered on October 29, 2009 (doc. # 10), that this case be dismissed without p rejud ice for the plaintiff's abandonment of his claims, his failure to comply with the orders o f the court and his failure to properly prosecute this cause of action. After a review of the re c o m m e n d a tio n , to which no timely objections have been filed, and after an independent re v ie w of the entire record, the court believes that the recommendation should be adopted.
