ORDER directing that, upon an independent review of the file in this case and upon consideration of the 12 Recommendation, it is ORDERED that the Recommendation is ADOPTED as follows: (1) Defendant's 7 Motion to dismiss is GRANTED, and Plain tiff's action is DISMISSED without prejudice; and (2) Plaintiff is GRANTED leave to file an amended Complaint on or beforeFebruary 23, 2011, to include factual allegations in support of her claim of pregnancy discrimination.
