ORDER AND OPINION that the 31 Recommendation of the Magistrate Judge be and is hereby ADOPTED and that: 1. The plaintiff's claims against a Macon County commissioner and the Mayor of Macon County are dismissed with prejudice prior to service o f process pursuant to the directives of 28 U.S.C. § 1915(e)(2)(B)(I). 2. The aforementioned defendants are dismissed as defendants in this cause of action. 3.
