Recommendation of the Magistrate Judge is overruled;
2. The Recommendation of the Magistrate Judge (Doc. #43) entered on November
7, 2013 is adopted;
3. The motions for preliminary injunction filed by the plaintiff on September 26, 2013
(Doc. #28) and October 10, 2013 (Doc. #34) are DENIED.
4. This case is referred back to the Magistrate Judge for additional proceedings.
