STATE DEFENDANTS’ MOTION TO DISMISS THE
UNITED STATES’ COMPLAINT (Doc. 1 in Case No. 11-cv-2746)
Governor Robert Bentley and the State of Alabama (“the State Defendants”),
pursuant to Rule 12(b) of the Federal Rules of Civil Procedure, move to dismiss
the claims of the United States raised in its complaint (Doc. 1) on grounds that the
United States has failed to state a claim upon which relief can be granted.
In support of this motion, the State Defendants rely on the arguments and
authorities presented in their “Response to United States’ Motion for Preliminary
Injunction” (Doc. 110, dated August 15, 2011), which pleading is adopted and
incorporated herein by reference.
