ORDER denying 35 Motion to Strike, except that is granted with respect to certain enumerated portions of the Don Keeler Declaration (doc. 30, Exh. E) which are stricken for lack of personal knowledge; granting in part and denying in part 42 Moti on to Strike or for Extension of Time (as set out); granting in part and denying in part 29 Motion for Summary Judgment. The Motion is denied with respect to (i) plaintiff's Title VII and Section 1981 pay discrimination claims relating to com parator Mike Martin; and (ii) plaintiff's Section 1981 retaliation claim relating to retaliatory job assignments.
