The BP Defendants file this joinder for the limited purpose of seeking a stay pending the Judicial Panel on Multidistrict Litigation's determination of whether this action should be consolidated pursuant to 28 U.S.C. § 1407 and if so, in what forum. The BP Defendants specifically reserve, and do not waive, any and all applicable defenses to the claims brought in this action including all defenses available under Rule 12 of the Federal Rules of Civil Procedure.
