This matter is before the Court on Defendant Hoar Construction, LLC’s “Unopposed Motion for Leave
to File Amended Answer,” to add the affirmative defense of voluntary payment (Doc. 70). It is ORDERED that
Defendant Hoar Construction, LLC’s unopposed Motion (Doc. 70) is GRANTED. Accordingly, Defendant
Hoar Construction, LLC is DIRECTED to file an Amended Answer1 which sets out in full -- rather than by
adopting and/or incorporating by reference – its allegations and counterclaim(s).2
