After due and proper consideration of all portions of this file deemed relevant
to the issues raised, and there having been no objections filed, the Report and
Recommendation of the Magistrate Judge made under 28 U.S.C. § 636(b)(1)(B) is
ADOPTED as the opinion of this Court.
It is ORDERED that defendant Stephenson’s motion to strike (Doc. 26) is
DENIED, plaintiff’s motion to strike (Doc. 59) is DENIED, defendant Stephenson’s
motion to re-align the parties (Doc. 3) is DENIED, and plaintiff’s motion to remand
(Doc. 30) is GRANTED.
Therefore, this action is hereby REMANDED to the
Circuit Court of Mobile County, Alabama.
