raised, and there having been no objections filed, the Report and Recommendation of the
Magistrate Judge (doc. 22) made under 28 U.S.C. ยง 636(b)(1)(B) is ADOPTED as the opinion
of this Court. Accordingly, it is ORDERED that this action is DISMISSED as time barred.
Petitioner is not entitled to a Certificate of Appealability and any request for leave to
appeal in forma pauperis is due to be denied.
