 facts
 allegedly
 omitted
 by
 the
 Magistrate

Judge
 had
 no
 affect
 on
 the
 recommendation
 regarding
 the
 TRO.

 Therefore,
 the

objection
 is
 overruled,
 and
 the
 Report
 and
 Recommendation
 is
 ADOPTED
 as
 the

opinion
 of
 this
 Court,
