Accordingly, it is ORDERED that Defendant’s motion to dismiss or in the alternative to transfer venue (Doc. 6) is GRANTED in part and DENIED in part as follows: DENIED as to the motion to dismiss; and GRANTED as to the motion to transfer venue such that this case is hereby TRANSFERRED in its entirety to the United States District Court for the Southern District of Mississippi pursuant to the provisions of 28 U.S.C. § 1406. The Clerk is DIRECTED to TRANSFER this action to the United States District Court for the Southern District of Mississippi, Southern Division.
