ORDER
After due and proper consideration of the issues raised, and there having been
no objections filed, the Recommendation of the Magistrate Judge made under 28 U.S.C.
§ 636(b)(1)(B) dated October 12, 2016, is ADOPTED as the opinion of this Court.
It is hereby ORDERED that the Defendant’s Motion to Dismiss (Doc. 18) is
GRANTED in part and DENIED in part, in that the motion is GRANTED as to the
facial components of Counts I, II, and II, and DENIED as to Count VII.
The Defendant is ORDERED to file its answer to the remaining counts on or
before November 14, 2016.
